The press department of SIL concern has published an announcement informing that the justice ministry’s department of mandatory fulfillment of orders has stopped the operation of Bjni factory. Together with the announcement the company has published their lawyer’s statement proving that the activities of the factory have been legal. The lawyer’s legal conclusion also contains information about the factory’s past performance starting from licensing till 2007, including the period when their activities were checked up (no violations were found as a result of checking the company’s financial records). According to this document, in one month after Levon Ter-Petrosyan’s speech on September 21, 2007, when the owner of Bjni factory MP Khachatur Sukiasyan was standing next to him, the taxation department of the government started checking up the activities of the factory. At first the taxation officers visited the factory with police officers from the police department on fighting organized crime and created an environment of fright at the factory. The lawyer specifically writes about the controls and revisions at their company, the fact that they have not found any violations, and comes to the conclusion that the only explanation of that attack by the governmental bodies is the fact that the Sukiasyans have been endorsing presidential candidate Levon Ter-Petrosyan during the presidential rival. “The company has applied to the administrative court of Armenia with a demand to disqualify the resolution of checking up the company. The judge of the administrative court A. Sargsyan resigned and refused to handle that court proceeding. Maybe he was not sure that he would be able to make a fair decision. The case was sent under consideration of judge of the administrative court Larissa Sosyan, who is known with her decisive character. The administrative court, represented by L. Sosyan, made an illegal decision to confiscate 4,067,201,600 AMD from the company. In consideration of the fact that the decision of the administrative court enters into force right after its adoption the taxation department did not wait till the company would appeal the decision and applied to the justice ministry department of mandatory fulfillment of judicial acts to charge that penalty,” informs layer A. Zohrabyan. The latter also informs that the officer of the judicial acts’ mandatory fulfillment department did not have the corresponding decision on setting up a group of officers to fulfill the duty, and on 23.10.2008 entered the company’s office in Yerevan and branch in Charentsavan with a group of people in black uniforms and no identification rank signs, who were in masks, closed the offices and confiscated the vehicles of the company. The company’s employees were forced to unemployment. Now the factory does not work. The company’s property is being sold by auction. “The management of the company has not done any illegal actions and the only sin they have made is their decision to elect and endorse one of the presidential candidates, namely Levon Ter-Petrosyan… According to the Armenian law it is prohibited to perform different level approaches and punishments by state bodies if there are no grounds that there is difference in substantiated facts of persecution. It turns out that the taxation committee can claim any time in the future that any actions of any companies are illegal. According to the testimony of an employee of the environmental protection ministry, the mines of Jermuk and Arzni have been closed based on the same principles,” writes Zohrabyan’s statement.
