Shahen Hovasapyan’s murder not revealed

Armen and Gurgen Virabyans are condemned for the murder. Colonel Armen Virabyan, 39, used to work under the supervision of Shahen Hovasapyan. He was the head of the seventh department. Gurgen Virabyan, 37, is a businessman, used to manage the “Semur & Co” company, which belonged to him. According to the investigators the motive of the murder is that Hovasapyan was planning to fire Armen Virabyan. Thus the two brothers decided to kill him. That’s the reason why Armen Virabyan recently prior to the murder became so close with Hovasapyan’s driver, Andranik Charchyan in order to stick an explosive under his car.

Prior to the time of charging accusations within 72 hours a face-to-face meeting was organized between Charchyan and Armen Virabyan. To the investigator’s question, “who Charchyan suspects of murder” the latter said, “I’m sure it’s Virabyan and maybe someone else by his order.” So far this is the only evidence that gave grounds to arrest the Virabyans. According to the attorney of Virabyans, Hovik Arsenyan, so far no other accusations were made and no more evidence brought up. Thus it’s not clear why the Virabyans are still in charge.

Right after the incident the investigators have been busy by finding new evidence against the Virabyans by digging into their economic activity and businesses. And now it’s clear; regardless of what the Virabyans are going to be arrested it’s not going to be the murder of Hovasapyan.

So far it’s not clear why second-class disabled Gurgen Virabyan is still in prison. His health has suffered a lot and every single day he spends in jail deteriorates his health even more. “The case is blocked,” that’s how attorney Arsenyan explained the process of the case.

“All the actions of the investigators and the prosecutors have been worn out and it was no way to bring up new evidence against the brothers. After the inquiries, searches, revelations the investigators drew a conclusion that the Virabyans are not guilty in committing this crime. But because of certain reasons they decided to ignore the legislation and the constitutional right of the charged ones. It turned about that both the evidence and the statements of motives are totally unreasonable,” said the attorney.

The investigators insist that the motive was that once Virabyan found out that Hovasapyan is going to fire him he decided to revenge on him. However, it’s known that Virabyan has been very loyal to Hovasapyan. They together used to develop and implement various operative actions. It’s already proven that on the day of the murder the Virabyans were in Yeghvard – in “Semur & CO” factory. But the accusations state that they were the ones, who committed the murder. “I think it’s impossible because they couldn’t physically press on the button,” says Arsenyan.

Certain media companies based on their sources publicized that illegal weapon was found in the summerhouse of Virabyans in Yeghvard. But in fact they found the gun of “Colt” model of Armen Virabyan, which he received because of his position and has never used it. One of the remote controls found there was of the child’s motorcycle, the other one – the TV remote control. I don’t blame the pre-examination body. I blame the investigation because it was done in an unprofessional and inefficient way. There was a crime but no evidence to arrest the Virabyans. Vice versa they should have let them go within 72 hours as required by the law. Then they went ahead and started to bring up evidence that Virabyan has established very close ties with Hovasapyan’s driver. They were just trying to find reason and fake evidence to keep the brothers in jail.

Of the last decisions of the investigator states, “We have evidence that in their business the Virabyans have done a lot of abuse and law violations, such as avoiding taxes.” No one knows the connections of avoiding taxes with Hovasapyan’s murder. The investigators forget that they’re entrusted to reveal the murder of Hovasapyan and not the businesses of Virabyans. This style of work perhaps became a reason to replace the head of the investigative group. Now the head is Hector Sardaryan.

The defense finds the innocence of Virabyans already proven. The first instance court of Kentron and Nork-Marash once again discussed the prolongation terms of the Virabyans charge and satisfied the claim on November 13. “In fact there is real pressure on the court to make them prolong their arrest,” said the attorney.
